This has given rise to the industrialization of a type of crime where the commodity—personal information—moves far too quickly for conventional law enforcement methods to keep pace.

To foster incentives for the development of products less likely to be attacked, initiate producer liability of software and other internet applications.

Through initiating producer liability of software, the information technology industry may develop from a product producer into a service provider, offering a spectrum of security services supplementary to their products. Fixed-term liability for damages resulting from cyber attacks would strengthen the industry’s incentives to develop, from the beginning, products that are more difficult and less likely to be attacked by cybercriminals.
